Marketing Policy

The rules for sending WhatsApp and other marketing messages through our platform: consent, opt-outs, content, templates and how we keep messaging safe for everyone.

  • Updated 5 November 2026

1. Why this policy exists

Good messaging respects the people who receive it. Customers who feel spammed block businesses, report them and lower their quality rating, and Meta can then restrict or ban the sending number. This Marketing Policy (also called our acceptable use and anti-spam policy) sets out what you must do when you send messages through WhatsApp Marketing Agency. It is part of our Terms and Conditions. You are responsible for the messages you send and for following this policy and the law.

2. Who the policy applies to

It applies to everyone who uses the platform: account owners, team members, agencies sending on behalf of clients, and anyone connected through our API or integrations. If you send on behalf of another business, you must make sure that business also follows this policy.

3. Consent: only message people who agreed

You may send marketing and promotional messages only to people who have clearly agreed to receive them from your business on that channel (opt-in).

  • Valid opt-in means the person was told who is messaging them, what kind of messages they will get and that it will be on WhatsApp (or the channel used), and then actively agreed. Examples: a checked, unticked-by-default box on a form, a click-to-WhatsApp ad where they started the chat, a message they sent you first, or a clear in-store or in-app request.
  • Consent must be specific to your business. Permission given to another company, a bought list or a general website visit is not enough.
  • Keep a record of when and how each person opted in. We may ask you to show it, and Meta may too.
  • Service and transactional messages (such as order updates the customer asked for) also need a valid relationship with the customer and must follow WhatsApp's template categories.

4. Lists you must never use

  • Purchased, rented, scraped or harvested contact lists.
  • Numbers collected without the owner's knowledge or from public directories, groups or social media.
  • Lists where the people never expected to hear from your business, or lists you cannot show an opt-in for.

5. Opt-out: make leaving easy and respect it

  • Every marketing campaign must give people a simple way to stop messages, for example replying STOP or tapping an opt-out button. Tell them how in your first message or template.
  • Honour opt-outs quickly and permanently. Remove or tag the contact so they are not included in later campaigns. Our platform lets you manage opted-out contacts; you must use it.
  • Never message someone again after they say stop, change numbers to get around the block, or punish them for opting out.
  • If a person blocks or reports your number, treat it as an opt-out.

6. Templates and message content

  • Marketing messages outside the customer service window must use a template approved by Meta. Choose the right category (marketing, utility, authentication) honestly. Mislabelling a promotion as a utility message is not allowed.
  • Be accurate and clear. Say who you are, make a real offer, and do not mislead people about price, availability, results or who is sending.
  • Use personal details (like names) only where they are correct and relevant. Do not use messages that pretend to be a person, a bank, a government body or another brand.
  • Keep messages relevant to what the person signed up for, and avoid sending too often. Many messages in a short time lead to blocks and a lower quality rating.
  • Do not ask for or send sensitive data in messages, such as passwords, full card numbers or government ID numbers, unless the use is lawful, necessary and securely handled.

7. Content that is not allowed

You must not use the platform to send or promote:

  • Anything illegal, or that helps someone break the law.
  • Scams, phishing, fake offers, pyramid schemes, fraudulent lotteries or deceptive financial offers.
  • Threats, harassment, hate, violence, abuse or content that exploits or endangers children.
  • Adult or sexually explicit content.
  • Products and services that Meta's WhatsApp Business Messaging Policy and Commerce Policy restrict or prohibit (for example illegal drugs, weapons, counterfeit goods, and other items on Meta's lists, which can change).
  • Malware, links to harmful sites, or content that tricks people into sharing information.
  • Political or election messaging that breaks the rules of the channel or the law.

Restricted industries may need extra checks or may not be allowed on some channels. If you are unsure, contact us before you send.

8. Follow Meta's and each channel's rules

You must follow the current WhatsApp Business Terms, WhatsApp Business Messaging Policy, Commerce Policy and Meta's advertising standards for click-to-WhatsApp ads, as well as the rules of Telegram, Facebook Messenger, Instagram and any other channel you use. Those rules change, and we cannot be responsible for the decisions Meta or other platforms make about your number, business or account.

9. Quality, limits and fair use

  • Watch your quality rating and messaging limit in your dashboard. If quality drops, pause and fix the cause (usually consent, relevance or frequency).
  • Do not try to avoid limits, rotate numbers to hide blocks, spread one campaign across many numbers or use multiple accounts to dodge enforcement.
  • Send in sensible batches and at sensible times. Respect the person's local time where you can.

10. Chatbots, AI and automation

  • Do not make a bot pretend to be a human when someone sincerely asks. Give an easy way to reach a person for anything important.
  • Automated replies must be accurate and must not make promises your business cannot keep.
  • Automations must still obey consent and opt-out rules: a flow must stop sending when someone opts out.
  • You are responsible for what your bots and AI-assisted replies say.

11. Click-to-WhatsApp ads and lead capture

When you run ads or forms that lead to WhatsApp, make the ad honest and make clear what happens when the person taps. Only message the leads you collect for the purpose they agreed to, and give them a way to opt out. Follow Meta's ad policies and any local advertising rules.

12. Personal data and your own duties

  • You are the one who decides how your customers' data is used. Make sure you have the notices, consent and lawful basis the law requires.
  • Follow the laws that apply to you, which can include telecom, consumer-protection, advertising and data-protection laws in your country and your customers' countries.
  • Delete or return data when a customer asks you to, and tell us if a data request affects information held on our platform.
  • See our Privacy Policy for how we handle data as your service provider.

13. Platform security and fair use

  • Do not attack, probe, overload or reverse engineer the platform, or share your login so others can avoid paying.
  • Do not use the API or exports to scrape data, or to build a competing service.
  • Do not resell or white-label the platform without a written agreement with us.

14. How we monitor and enforce

We may review campaigns, templates, complaint rates, quality scores and reports from Meta, recipients and others. If we think this policy is being broken, we may:

  • Ask you for proof of consent or more information.
  • Pause a campaign, remove content or limit features.
  • Suspend or end your account, without a refund as set out in our Refund Policy.
  • Pass information to Meta, other platforms or the authorities where required or appropriate.

We try to act fairly and, where it is safe to, give you a chance to fix the problem. For serious or repeated breaches we may act immediately.

15. Reporting abuse

If you received a message sent through our platform that breaks this policy, or you want to stop messages, tell us at info@whatsappmarketingagency.com with the number you received it from, the date and a screenshot if you can. We will look into it and act where needed. You can also block and report the sender inside WhatsApp.

16. Checklist before you send

  • Do I have a recorded opt-in for every person on this list?
  • Does the message say who I am and tell people how to stop?
  • Is the template category honest and approved?
  • Is the content accurate, relevant and allowed?
  • Is my frequency reasonable, and is my quality rating healthy?

17. Changes to this policy

Messaging rules change, so we may update this policy. The new version will be posted here with a new "last updated" date. Continuing to use the platform after a change means you accept it.
